End-User License Agreement (EULA)

This End-User License Agreement (“EULA”) is a legal agreement between you (“User” or “Licensee”) and Wescle Suite (“Company,” “we,” “us,” or “our”) governing the use of Wescle Suite software, including plugins, templates, and associated services (“Software”). By installing, accessing, or using the Software, you agree to the terms outlined in this EULA.

1. License Grant & Scope

1.1 License Type:

  • We grant you a non-exclusive, non-transferable, revocable license to use Wescle Suite Software strictly in accordance with this EULA.

1.2 Scope of Use:

  • The Software is licensed, not sold, and is provided solely for use on the specified domains as per your active subscription plan.
  • You may use the Software for personal or commercial websites, subject to the terms of this EULA.

1.3 Restrictions:

  • You may not modify, distribute, sublicense, sell, lease, or rent the Software.
  • Reverse engineering, decompiling, or attempting to access the Software’s source code is strictly prohibited.
  • Unauthorized use of AI-generated content, including resale or redistribution without permission, is forbidden.
  • The Software may not be used to develop competing products or services.

2. AI-Generated Content & Ownership

2.1 Content Ownership:

  • Users retain ownership of content they generate using the Software. Wescle Suite does not store, access, or process any user-generated content. All content remains solely on the user’s website or hosting environment.
  • AI-generated content is subject to limitations based on third-party API agreements (e.g., OpenAI, Google APIs, Stability AI).

2.2 Limitations on AI Content Usage:

  • AI-generated content must not be used for deceptive, misleading, or unlawful purposes.
  • We do not guarantee the accuracy, originality, or legality of AI-generated content. AI can make mistakes. Check important info.

3. Prohibited Uses

3.1 You may not:

  • Use the Software to violate any applicable laws or regulations.
  • Distribute, copy, or modify the Software without authorization.
  • Use the Software in ways that disrupt our services or the services of third-party providers.
  • Circumvent security measures or attempt unauthorized access to the Software.

3.2 License Enforcement:

  • We reserve the right to track software usage and verify compliance with licensing terms.
  • Violations may result in immediate suspension or termination of your access to the Software.

4. Termination & Suspension

4.1 Termination by User:

  • You may terminate this EULA by canceling your subscription and ceasing use of the Software.

4.2 Termination by Wescle Suite:

  • We reserve the right to terminate or suspend access if:
    • You violate this EULA.
    • Unauthorized or illegal use of the Software is detected.
    • Your subscription expires and is not renewed.

4.3 Effect of Termination:

  • Upon termination, all rights granted under this EULA will immediately cease.

5. Warranty Disclaimer

5.1 No Warranty:

  • The Software is provided “as-is” without any warranties of any kind, either express or implied.
  • We do not guarantee uninterrupted, error-free, or secure operation of the Software.

5.2 Limitation of Liability:

  • We shall not be liable for any indirect, incidental, consequential, or punitive damages arising from the use of the Software.
  • In no event shall our total liability exceed the amount paid for the subscription in the preceding 12 months.

6. Updates & Modifications

6.1 Software Updates:

  • We may release updates, patches, or new versions of the Software.
  • Users are required to install updates (backup before updates) to maintain service functionality and security.

6.2 Modifications to EULA:

  • We reserve the right to modify this EULA at any time.
  • Continued use of the Software after modification constitutes acceptance of the updated terms.

7. Governing Law & Dispute Resolution

7.1 Governing Law:

  • This EULA is governed by and construed in accordance with the laws of Ukraine.

7.2 Dispute Resolution:

  • Any disputes arising from this EULA shall be resolved through arbitration in Ukraine.
